1. Introduction

These Terms of Service ("Terms") govern your use of the FollowUpCall service ("Service") operated by an individual based in Victoria, Australia ("we", "us", "our").

By accessing or using the Service at followupcall.me, you agree to be bound by these Terms. If you do not agree, you must not use the Service.

2. Service Description

FollowUpCall is a reminder service. You send an email to a time-based address (e.g., [email protected]), and we deliver a reminder via email and/or phone call at the scheduled time. The Service also provides a web dashboard for managing your tasks and account settings.

3. Account Registration

You must sign in using Google OAuth to create an account. You are responsible for maintaining the security of your Google account and for all activity that occurs under your FollowUpCall account. You must provide accurate and complete information, including a valid phone number if you wish to receive phone call reminders.

4. Acceptable Use

You agree not to:

  • Use the Service for any unlawful purpose or in violation of any applicable laws or regulations.
  • Send spam, unsolicited messages, or abusive content through the Service.
  • Attempt to gain unauthorised access to the Service, other accounts, or our systems.
  • Use the Service to harass, threaten, or harm any person.
  • Reverse-engineer, decompile, or disassemble any part of the Service.
  • Exceed reasonable usage limits or use automated tools to generate excessive load on the Service.

5. Call and Email Limits

The number of phone calls and email reminders you can use depends on your subscription plan. Free accounts are limited to 3 phone calls per month. Paid plans have higher limits as described on our pricing page. We reserve the right to modify these limits at any time with reasonable notice.

Phone calls are placed using Twilio and are subject to availability in your region. Not all countries or phone number types are supported.

6. No Guarantee of Delivery

While we strive to deliver all reminders on time, we do not guarantee the delivery, timing, or completeness of any email or phone call reminder. Delivery may be affected by factors outside our control, including but not limited to:

  • Email provider spam filters or delivery delays.
  • Phone network outages or congestion.
  • Third-party service provider downtime (AWS, Twilio).
  • Invalid or unreachable phone numbers.

You should not rely on FollowUpCall as the sole reminder for critical, time-sensitive, or safety-related tasks.

7. Fees and Payment

The Service offers both free and paid subscription plans. Pricing is displayed on our website and may change with reasonable notice. Paid subscriptions are billed in advance on a monthly basis. All fees are non-refundable except as required by Australian Consumer Law.

8. Intellectual Property

All content, trademarks, and intellectual property associated with the Service are owned by FollowUpCall or its licensors. You retain ownership of any content you submit through the Service (such as email content for reminders), but you grant us a limited licence to process and store that content solely for the purpose of delivering the Service.

9. Limitation of Liability

To the maximum extent permitted by law, FollowUpCall and its directors, employees, and agents shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, data, or business opportunities, arising out of or in connection with your use of the Service.

Our total aggregate liability for any claim arising from or related to the Service shall not exceed the amount you have paid us in the 12 months preceding the claim, or AUD $50, whichever is greater.

Nothing in these Terms excludes or limits any rights you may have under the Australian Consumer Law or any other applicable legislation that cannot be excluded by agreement.

10. Disclaimer of Warranties

The Service is provided on an "as is" and "as available" basis without warranties of any kind, whether express or implied, to the extent permitted by law. We do not warrant that the Service will be uninterrupted, error-free, or free of harmful components.

11. Termination

You may stop using the Service at any time by contacting us at [email protected] to request account deletion.

We may suspend or terminate your account at any time if we reasonably believe you have violated these Terms, or for any other reason with 30 days' notice. Upon termination, your right to use the Service ceases immediately, and we may delete your data in accordance with our Privacy Policy.

12. Privacy

Your use of the Service is also governed by our Privacy Policy, which describes how we collect, use, and protect your personal information.

13. Changes to These Terms

We may update these Terms from time to time. If we make material changes, we will notify you by email or by posting a notice on the website. Your continued use of the Service after changes are posted constitutes acceptance of the updated Terms.

14. Governing Law

These Terms are governed by and construed in accordance with the laws of the State of Victoria, Australia. Any disputes arising under or in connection with these Terms shall be subject to the exclusive jurisdiction of the courts of Victoria, Australia.
